1.2 "Customer" means anyone who orders from us. A consumer is an individual acting outside their business or profession.

Article 2 - Scope and agreements

2.1 These terms apply to our offers, orders and contracts unless we expressly agree otherwise.

2.2 When ordering, you check a box to confirm that you have read and accept these terms. You can save these terms. We will send a free copy on request.

2.3 We record any variations in writing, for example by email. They override the relevant provision; the remaining terms still apply.

2.4 For business orders, we expressly reject the customer's own terms unless we accept them in writing.

2.5 We may use third parties for production and shipping, for example. This does not change our obligations to you. Where legally permitted, protective provisions may also apply to third parties we engage to fulfill the contract.

2.6 These terms do not limit any consumer rights that cannot legally be restricted.

Article 3 - Offers and forming the contract

3.1 We describe products, options and prices as carefully as possible. The offer shows the available choices, such as image, material, size, finish and hanging system.

3.2 Limited-time offers are subject to their stated duration and promotional terms.

3.3 Obvious errors are not binding where you could reasonably have recognized a mistake. A low price is not automatically an obvious error.

3.4 Before ordering, check the image, crop, dimensions, options, quantities, contact details and shipping details.

3.5 The contract is formed when we accept your order. We confirm this by email. An automated acknowledgment only constitutes acceptance if its content makes this clear.

3.6 If we cannot accept an order, we will tell you as soon as possible, within ten business days of receipt at the latest. We will promptly refund any payment received for that order.

3.7 We do not change an accepted order without your agreement. We will discuss any necessary changes with you.

Article 4 - Prices and payment

4.1 Consumer prices are in pounds sterling and include VAT and other mandatory taxes. Shipping charges and additional costs are those agreed when you order.

4.2 The agreed price applies to an accepted order. Later changes to our selling prices do not affect it.

4.3 Payment is made using one of the methods available at checkout.

4.4 At GardenCanvas.com, you pay the full order amount upfront. We deliver your order once full payment has been received.

4.5 For business orders, we may agree full payment in advance.

4.6 For late payment, we may charge statutory interest once the legal requirements are met.

4.7 Before a consumer becomes liable for debt collection costs, they receive a free reminder allowing fourteen days to pay, starting the day after receipt. This states the collection costs payable if payment is not made. We charge no more than legally permitted.

4.8 We do not charge extra administration or reminder fees on top of collection costs where the law prohibits this.

4.9 If a due payment remains unpaid, we may suspend or terminate the contract where legally permitted and justified by the breach. The customer's statutory rights to withhold performance remain unaffected.

Article 5 - Gift cards

5.1 This article applies to gift cards issued by GardenCanvas.com. Gift cards can only be used at GardenCanvas.com to buy a garden canvas.

5.2 A gift card is valid for two years from its issue date. The issue and expiration dates appear on the card or its confirmation.

5.3 The card code can be used once, for one order. Please spend its full value at once. If your purchase costs less, the unused balance is lost: it cannot be spent later or refunded.

5.4 If your chosen garden canvas costs more than the card value, you pay the difference.

5.5 Gift cards cannot be exchanged for cash. This provision and the single-use restriction do not limit statutory rights to cancellation, refunds or reinstatement of credit, for example if an order paid for with a card is lawfully terminated.

5.6 Separate promotional terms may apply to free promotional codes or discount coupons.

Article 6 - Images and intellectual property

6.1 If you supply a photo, design, logo or other file, you must hold the rights and permissions needed to have it printed.

6.2 You authorize us to use the file to assess, prepare and fulfill your order. We may share it with the production partners involved for this purpose.

6.3 Your copyright is not transferred to us. Any other use requires a separate legal basis or permission.

6.4 You are responsible for the content supplied and your chosen crop and dimensions. Our own responsibilities, including promised file checks and advice, remain unaffected.

6.5 Preferably use an original file with sufficient resolution. Blur, compression and missing detail may remain visible in the print.

6.6 Rights to collection images, designs and website content remain with their owners. Buying a canvas does not authorize you to copy, publish or commercially reproduce the image separately.

6.7 We may reject a file if we have reasonable grounds to suspect unlawful content or infringement of third-party rights. We will inform you and discuss a possible solution.

Article 7 - Dimensions, finish and image

7.1 We supply garden canvases accurate to the centimeter. This also applies to garden canvases with eyelets whose length or width exceeds 200 cm.

7.2 Garden canvases with a tunnel hem finish are an exception: the final width and height may each be up to 3 cm smaller or larger than ordered.

7.3 Dimensions depend on your chosen option and the product's measuring method: canvas size, visible size or overall size including the frame. The separate tolerance in article 7.2 applies to tunnel hem finishes.

7.4 Size tolerances do not remove our duty to supply a product that meets the contract and has the qualities you can reasonably expect.

7.5 For cutting and finishing, we allow a trim area of 1 cm on each side. Parts of the image within this border may be lost. This trim area is separate from the delivered canvas dimensions in articles 7.1 and 7.2.

7.6 Keep important details, such as faces, text and logos, outside the marked cutting and finishing area. The technical trim allowance does not exclude liability for incorrect cropping or finishing.

7.7 Screens and printed surfaces reproduce colors differently. Settings, material and lighting may cause slight differences. The delivered product must still match the contract and our product information.

7.8 When assessing an imperfection or damage, we consider its visibility, location, use and the quality you could expect. An irregularity of up to 2 mm is not automatically excluded from a complaint or statutory protection.

Article 8 - Shipping, risk and ownership

8.1 The estimated shipping time appears with the product, during checkout or in the confirmation. Unless otherwise agreed, we deliver consumer orders within thirty days of the contract being formed.

8.2 We will tell you of any delay as soon as possible.

8.3 If shipping misses the agreed deadline, you can generally give us a reasonable additional period. If shipping still does not take place, you can terminate the contract. No extra period is needed where the law allows immediate termination, for example if an essential shipping date specified beforehand is missed.

8.4 Following lawful termination for non-shipping, we will promptly refund payments for the terminated part.

8.5 We deliver to the address supplied. Please send corrections as soon as possible. We only charge extra costs caused by incorrect details where agreed, reasonable and legally permitted.

8.6 For consumer orders, we bear the shipping risk until you or a third party you nominate, other than the carrier, receives the product. A statutory exception may apply if you appoint a carrier we did not offer.

8.7 Contact us if an expected package or one marked as delivered is missing. Your statutory rights do not expire ten or twenty days after ordering.

8.8 Products remain our property until their purchase price has been paid. This does not affect statutory rules on shipping and risk.

Article 9 - Custom-made products, returns and cancellation

9.1 All GardenCanvas.com garden canvases are made to the dimensions supplied by the customer. We do not offer standard sizes. This applies both to images from our collection and to photos or designs supplied by the customer.

9.2 These garden canvases are non-prefabricated products made to the customer's individual specifications. These custom-made products therefore have no statutory cooling-off right.

9.3 A correctly supplied custom-made canvas cannot be returned because you change your mind or preferences, or supplied the wrong size. Carefully check the width, height, image, crop and finish before ordering. We remain responsible for our own mistakes or incorrect advice.

9.4 To change or cancel an order, contact us as soon as possible at [email protected] or 0330-8088469. We will check whether this is still possible. The fact that production has not yet started does not itself create a statutory cooling-off right for these custom-made products.

9.5 We may voluntarily agree to a change or cancellation. Any costs form part of that agreement, taking account of costs saved. We will record the agreement in writing.

9.6 The custom-made exception does not limit statutory rights concerning defects, damage, incorrect shipping or failure to meet our obligations. If the canvas does not match your order or have the qualities you can reasonably expect, article 10 applies.

9.7 This exception covers garden canvases made to individual customer dimensions. It does not exclude statutory rights for a gift card bought separately.

Article 10 - Complaints and statutory rights

10.1 Products must meet the contract and have the qualities you can reasonably expect.

10.2 Check the canvas and packaging before hanging, preferably as soon as it arrives. If you find visible damage, report it immediately to [email protected] and do not hang the canvas. Contact us first for assessment and instructions. Please report visible damage on the day of receipt or the next day at the latest. If possible, photograph the whole canvas, damage, packaging and shipping label, and keep the packaging for inspection.

10.3 If you later discover a defect that was not visible during the initial check, contact us as soon as possible. We will investigate your report and discuss how to resolve it. The checking and reporting instructions do not affect your statutory rights.

10.4 Send your complaint to [email protected], preferably with your order number, a description and any photos.

10.5 For faulty products, statutory rights include repair or replacement and, where legal conditions are met, a price reduction or termination.

10.6 Statutory remedies are free, including necessary inspection, transport, repair or replacement costs, and are provided within a reasonable time without significant inconvenience.

10.7 We are not responsible for damage demonstrably caused by the customer during unpacking, hanging or use, unless its cause lies with us, such as a product defect or incorrect installation instructions. If you hang a canvas despite visible damage and this demonstrably causes further damage, you may bear the cost of that extra damage where legally permitted. We assess the cause using the available information and statutory rules of evidence. Inadequate maintenance may also fall outside our responsibility where it is demonstrably the cause and attributable to the customer. The checking and installation instructions do not limit your statutory rights concerning an original defect.

10.8 We may ask for reasonable cooperation with an investigation. A rejected complaint does not automatically incur charges. We only carry out paid work outside statutory protection once you have agreed to the work and costs.

Article 11 - Additional color guarantee

11.1 GardenCanvas.com offers an additional 3-year color guarantee on all garden canvases, from receipt of the original canvas. This guarantee applies in all countries.

11.2 The additional color guarantee applies if color intensity falls by at least 50% compared with the original print. We assess fading using photos supplied by the customer. If the photos are unclear, we will request further photos or details and explain our assessment.

11.3 The guarantor is Dtp Studio Schuurman, Parkweg 22, 8161 CK Epe. Submit color guarantee claims to [email protected], with proof of purchase and clear photos of the canvas and fading.

11.4 For a valid claim, we offer a suitable solution. Normally, you receive a new canvas free of charge. If replacement is not possible or appropriate, we will agree another suitable solution with you. GardenCanvas.com pays the necessary transport costs, including shipping of the replacement canvas and any return we require.

11.5 The additional guarantee does not cover fading demonstrably caused by unsuitable cleaners, external damage for which we are not responsible, use contrary to the supplied instructions or inadequate maintenance that caused the fading.

11.6 Maintain the canvas as instructed. Gently remove bird droppings, prevent damaging snow buildup and use suitable cleaning products and tools.

11.7 The additional color guarantee allows one fulfilled claim per originally purchased canvas. Once we have fulfilled that claim through replacement or another agreed suitable solution, no further claim under this additional color guarantee can be made for that canvas or any replacement. Simply reporting or assessing a complaint does not use up this entitlement. Replacement does not start a new commercial guarantee period.

11.8 A rejected claim does not automatically incur inspection charges or other business costs. Article 10.8 still applies. You will receive these guarantee terms in a form you can keep.

Article 12 - Communication and liability

12.1 We use the contact details supplied. Please report changes or errors as soon as possible.

12.2 If an expected confirmation is missing or a message seems to have gone astray, contact us. We investigate communication problems relevant to your order.

12.3 Internet, email or other communication failures do not automatically exclude our liability. We remain responsible for failings attributable to us by law.

12.4 Statutory liability rules apply to damage connected with performance of the contract.

12.5 Our assessment takes account of causes and circumstances attributable to the customer. For example, we are not responsible for damage caused solely by incorrect self-installation if we provided correct and sufficient instructions.

12.6 These terms do not exclude liability that cannot be excluded under mandatory law.

Article 13 - Force majeure

13.1 Force majeure means an obstacle to performance for which we cannot be held responsible by law.

13.2 We will tell you as soon as possible about any effects on your order.

13.3 For a temporary obstacle, we may suspend performance where legally permitted. We will discuss the effects on shipping with you.

13.4 If performance becomes permanently impossible or a statutory right to terminate arises, the contract may end in whole or in part. We will refund payments for anything we cannot supply.

13.5 Force majeure does not automatically entitle you to compensation. Statutory rules govern liability and other rights.

Article 14 - Other provisions

14.1 An exception or a delay in enforcing a provision does not automatically mean we waive it in the future. Specific agreements and legitimate expectations remain relevant.

14.2 If a provision is invalid or unenforceable, the remaining provisions continue to apply where possible. The relevant statutory rules govern that matter. We will not unilaterally impose a replacement provision that weakens your legal position.

14.3 New versions apply to future contracts. An existing order generally remains subject to the version applicable when the contract was formed.

Article 15 - Governing law and disputes

15.1 Our contracts are governed by Dutch law.

15.2 This choice does not deprive consumers of protection under mandatory rules of the law that would otherwise apply.

15.3 If a dispute arises, contact us first so we can try to find a solution.

15.4 Disputes may be brought before the court with jurisdiction under applicable law. Consumers retain any statutory right to bring proceedings before another competent court.
